Terms and Conditions

These Terms and Conditions apply to the use of the online marketplace (“the Platform”) operated by Viora Jewellery hereinafter referred to as “the Platform Operator”. These terms are binding for all users of the Platform, including but not limited to individuals and legal entities who offer or purchase products via the Platform. By creating an account and/or placing an order or listing, the User expressly agrees to be bound by these Terms.


Article 1 – Definitions

1.1 Platform: The online infrastructure, including website, app, and supporting systems, made available by the Platform Operator to facilitate transactions between Suppliers and Customers.

1.2 Platform Operator: The legal entity that owns and manages the Platform, responsible for its technical operation, compliance, and ongoing maintenance.

1.3 Supplier: Any natural or legal person who registers on the Platform with the intent to offer and sell goods to third parties.

1.4 Customer: Any natural or legal person who purchases goods via the Platform.

1.5 User: A collective term referring to both Suppliers and Customers, as well as any individual or entity making use of the Platform.

1.6 Product: Any tangible good listed for sale via the Platform.

1.7 Service Fee: Any fee charged by the Platform Operator to the Supplier for the provision of Platform services.

1.8 Force Majeure: Any circumstance beyond reasonable control preventing performance of contractual obligations.


Article 2 – Applicability

2.1 These Terms apply to every use of the Platform and to all agreements concluded between Suppliers and Customers through the Platform.

2.2 Deviations from these Terms are only valid if agreed in writing by the Platform Operator.

2.3 If any provision is declared void, the remaining provisions shall remain in force.

2.4 The Platform Operator may amend these Terms at any time. Continued Platform use constitutes acceptance of updates.

2.5 The Platform is operated by Jonges E-Commerce, registered with the Dutch Chamber of Commerce under number 93546858, VAT number NL005025803B13, with its registered address at Schepenlaan 115, 1671 TA Medemblik, The Netherlands.


Article 3 – Registration and Use

3.1 Users must register an account to access full functionality and provide accurate information.
3.2 Users are responsible for safeguarding login credentials.
3.3 Multiple or transferred accounts are prohibited without permission.
3.4 Accounts may be suspended in cases of misuse or suspected fraud.


Article 4 – Listings and Product Information

4.1 Suppliers must provide accurate and honest product descriptions.
4.2 Illegal, counterfeit, or infringing products are prohibited.
4.3 Suppliers must comply with all applicable laws.
4.4 Pricing remains the responsibility of the Supplier.


Article 5 – Orders and Fulfillment

5.1 An order constitutes a binding purchase offer.
5.2 Suppliers must fulfill confirmed orders and provide tracking.
5.3 Delays must be communicated immediately.
5.4 Risk transfers to the Customer upon confirmed delivery unless agreed otherwise.


Article 6 – Right of Withdrawal and Returns

6.1 Customers may withdraw within 30 days of receipt.
6.2 Returned Products must be sent back within 14 days of withdrawal notice.
6.3 Refunds must be issued within 30 days of Product return.
6.4 Exceptions apply to non-returnable Products where legally permitted.


Article 7 – Payments, Fees, and Taxes

7.1 Payments are processed via an independent third-party provider.
7.2 Service Fees may be charged to Suppliers.
7.3 Suppliers are responsible for tax compliance.
7.4 Suppliers are liable for chargebacks and related costs.


Article 8 – Liability and Indemnity

8.1 Suppliers are responsible for product safety, legality, and compliance.
8.2 The Platform Operator is not a contractual party to sales agreements.
8.3 Users indemnify the Platform Operator from third-party claims.
8.4 Liability is limited except in cases of gross negligence or willful misconduct.


Article 9 – Intellectual Property

9.1 All Platform content remains the property of the Platform Operator or licensors.
9.2 Suppliers grant a limited license for submitted content.
9.3 Infringing content may be removed immediately.


Article 10 – Data Protection and Privacy

10.1 Personal data is processed in accordance with applicable laws (including GDPR).
10.2 Data is processed only for operational purposes.
10.3 Data is not shared unless necessary or legally required.


Article 11 – Prohibited Conduct

11.1 Unlawful or harmful use of the Platform is prohibited.
11.2 The Platform Operator may suspend or terminate violating accounts.
11.3 Violators are liable for resulting damages.


Article 12 – Force Majeure

12.1 Neither party is liable for non-performance due to Force Majeure.
12.2 If Force Majeure lasts over 30 days, either party may terminate the agreement.
12.3 The affected party must notify the other promptly.


Article 13 – Termination and Suspension

13.1 Users may terminate their account if all obligations are fulfilled.
13.2 The Platform Operator may suspend or terminate accounts in case of breach.
13.3 Termination does not cancel existing obligations.


Article 14 – Governing Law and Dispute Resolution

14.1 These Terms are governed exclusively by the laws of the United Kingdom.
14.2 Disputes shall be submitted to the competent court in the district of the Platform Operator’s headquarters, unless mandatory law dictates otherwise.
14.3 Parties may alternatively agree to arbitration or ADR.
